Terms and Conditions of Elixir Body Care Ltd (the company)
All goods are supplied subject to the following terms and conditions. By placing an order you are agreeing to these terms and conditions. Any variation of these terms and conditions must be agreed by both parties and must be in writing.
All prices shown and quoted are ex-works and net of VAT. VAT will be added to the invoice at the rate ruling on the invoice date for all destinations inside the UK and EU areas, VAT will not be added to goods destined beyond the EU area.
Unless agreed by the company under the company's credit terms all goods must be paid for either at the time of collection or before despatch.
All goods remain the property of the company until paid for in full.
Risk in the goods shall pass to the purchaser at the time of delivery unless goods are collected in which case risk passes to the purchaser when the goods leave the company's premises.
All claims for damages or short delivery must be made within 7 days of receipt of order giving full details and a photograph if possible.
In the event that any part of these terms and conditions is found to be unlawful, it shall not affect the validity of the remaining part.
If the purchaser has a credit agreement with the company then the terms of that credit agreement are deemed to be an extension to these terms and conditions and both parties hereby agree to that extension.
Any legal proceedings arising from the application of these terms and conditions shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh courts to which both parties hereby submit. All proceedings arising under this clause shall be conducted in the English language.
EXPORT FROM THE UK
All product prices are ex-works and any purchaser who wishes to take delivery outside of the United Kingdom must satisfy themselves of all and any Excise Duty, Customs Duty or import taxes of any kind applicable to the import into the intended country or state and the purchaser is responsible for all such duties and taxes. If any freight charges are incurred by Elixir due to the goods being returned, the company reserves the right to claim these charges from the purchaser.
CONDITION OF USE OF DISCLAIMER
The company disclaims any responsibility for any adverse reactions caused by incorrect or inappropriate use and it is the purchaser's responsibility to advise their customers of this disclaimer.
Whilst we do our best to offer you the finest quality products, natural ingredients, by their very nature differ from batch to batch and the company cannot guarantee the consistency of their natural products from one batch to another therefore returns will not be honoured if they are only based on these variations Any product claims and disputes fall under United Kingdom jurisdiction under the legal system of England and Wales and will be dealt with by the company's insurers from the outset of any claim.
